HexaOps Service Terms
Version 1.1 — 5 August 2026 (v1.0: 24 July 2026). These terms are written in plain English on purpose. They apply to services ordered from HexaOps LLC (a US company, "HexaOps", "we") through a signed order form or online order ("Order"). The Order and these terms together are the whole agreement. Where these terms and your Order differ, the Order wins.
1. The services
We build, host and run your website and — depending on your plan — your direct ordering and customer tools. Your plan's inclusions are listed on your Order. In day-to-day words:
- Vitrine — your site, live on your own domain. The monthly covers hosting, SSL, your domain name (registration and renewal), uptime monitoring, platform updates, a self-serve studio to edit your menu, prices, hours and photos yourself (unlimited), a Google-review invitation after each recorded visit, and content changes done for you on request (up to 2 change requests a month, actioned within 2 business days).
- Direct — everything in Vitrine, plus table-QR and pickup ordering at 0% commission, orders on a live kitchen screen (your own phone or tablet — no extra hardware required), live order status for your customers, table bookings with live slots and capacity, a loyalty card by phone number, your customer list and newsletter, your live order and day sheets, and hands-on support.
- Partner — everything in Direct, plus your point-of-sale on a tablet (works offline; split bills, discounts, cash and change), your day's close to the cent on an immutable payment ledger with emailed receipts, multi-location screens and calendars, a staff training day, on-site go-live, and priority support. Hardware is supplied at cost and itemised on your Order. Card-terminal integration and accounting exports are delivered as they go live for your venue and are never billed before they work for you.
We provide the services with due care and skill. We may improve how a feature works over time, but we will not remove a listed inclusion from your plan during a period you have paid for.
2. Going live
Your site is typically live on your own domain within 2 weeks of your confirmation — provided we have received your details (the ~10-minute intake). Founding prices and their deadline are as dated on your Order.
3. Payment
- Setup: 50% deposit on signing, balance when your site goes live.
- Monthly: billed in advance, starting at go-live. On Direct, the monthly is waived during the go-live support period shown on your Order.
- Yearly: pay 12 months up front and get 2 months free.
- If a payment fails: we tell you and allow at least 14 days to fix it before suspending the service. We restore it as soon as payment arrives, and we keep your site and data intact for at least 60 days after any suspension.
- Prices are in Australian dollars. HexaOps LLC is a US company and is not registered for Australian GST; no GST is charged. If you are GST-registered, ask your accountant whether the reverse-charge rules apply to you.
4. What is yours, what is ours
- Yours: your content (menu, texts, photos you provide), your customer data, your domain name and your site. The domain is yours from day one: we register and renew it on your behalf, and transfer it into your own registrar account at no charge whenever you ask. Your customer list exports in one click from your owner dashboard, at any time — not just when you leave.
- Ours: the HexaOps platform, templates and software that power your site. You have a non-exclusive licence to use them for as long as you use the service.
- If you leave: on request within 60 days of cancellation, we provide — free — a static export of your site and a CSV export of your customer data, within 14 days.
5. Your responsibilities
You are responsible for the accuracy of what your site and menu display (prices, hours, allergen and dietary information), for having the rights to any material you give us, and for using the service lawfully. Photos we source are licensed before any public launch.
6. Your customers' data
Order, booking and lead data collected through your site belongs to you. We process it only to run the service (delivering orders to your kitchen, bookings, your day sheets), we never sell it, and we store it with reputable infrastructure providers. Each of us complies with the privacy law that applies to us — including, for your business, the Australian Privacy Act where applicable.
7. Service quality and liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Where the law allows liability for services to be limited, our liability is limited to resupplying the services, or paying the cost of having them resupplied. Neither of us is liable to the other for indirect or consequential loss. We make no promise about revenue or sales results — we show real numbers and sourced figures, and anything shown as an estimate is exactly that.
8. Cancelling and changes
- You can cancel a monthly plan at any time, effective at the end of the current billing period — no cancellation fee, no lock-in. If you cancel a yearly plan, we refund the remaining full months at the equivalent monthly rate.
- We can end the service with 60 days' written notice, refunding anything you have prepaid past the end date. We can suspend earlier for non-payment (clause 3) or unlawful use, after telling you.
- Price changes take effect no sooner than 60 days after we tell you, and never during a period you have already paid; you can cancel before a change applies.
- Changes to these terms: we give 30 days' notice of material changes; the version you signed keeps applying to any period you have already paid for.
9. General
If part of these terms is found unfair or unenforceable, the rest still applies. These terms are governed by the law of Western Australia, and the courts of Western Australia have non-exclusive jurisdiction — without limiting any protection the Australian Consumer Law gives you.
